This Consumer Health Data Privacy Policy describes how Sofrena ("we," "us") collects, uses, and shares "consumer health data" as defined by the Washington My Health My Data Act, Nevada's consumer health data law (SB 370), and similar laws. It supplements our Privacy Policy and applies to all visitors and users of sofrena.com and our programs whose information is covered by those laws.
1. What "Consumer Health Data" Means at Sofrena
Consumer health data is personal information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status. Because Sofrena is an education community focused on perimenopause and menopause, the consumer health data we may collect is limited and specific:
- Survey responses you choose to share about your experiences, symptoms, or health journey related to perimenopause and menopause;
- Questions you submit for expert sessions or forums, to the extent they describe your health experiences;
- The inference, arising from your voluntary participation in Sofrena programs, that you may be experiencing or interested in perimenopause or menopause.
We do not collect biometric data, genetic data, precise geolocation, reproductive health records, medical records, diagnoses from providers, or data from health apps or wearables.
2. How We Collect It
We collect consumer health data only directly from you, only when you volunteer it — through our surveys, signup forms, and submitted questions — and only with your consent. We do not purchase consumer health data, derive it from third parties, or infer it through tracking technologies.
3. Why We Collect and Use It
We collect and use consumer health data solely to: plan and improve Sofrena's educational content and programming; understand, in aggregated and de-identified form, what our community wants to learn; prepare expert sessions that answer the questions our members actually have; and provide the Services you request. We do not use consumer health data for advertising of any kind.
4. How We Share It
We do not sell consumer health data, and we will never sell it. We do not share consumer health data with advertisers, data brokers, or analytics providers for their own purposes. We share it only with: service providers acting on our behalf and under contractual confidentiality obligations (our survey platform and email platform, solely to store and process the data for us); professional advisors under duties of confidentiality; and recipients required by law, legal process, or to protect safety. A current list of the categories of third parties and affiliates with whom we share consumer health data is available by emailing [email protected].
5. Your Rights
If you are a resident of Washington, Nevada, or another state with a consumer health data law, you have the right to:
- Confirm and access — confirm whether we are collecting, sharing, or selling consumer health data about you and access that data, including a list of third parties with whom we have shared it;
- Withdraw consent — withdraw your consent to our collection and sharing of your consumer health data at any time;
- Delete — request deletion of your consumer health data, including from our backups and from our service providers, within the timelines your state's law requires;
- Non-discrimination — exercise these rights without being denied access to Sofrena's free content or treated differently.
6. How to Exercise Your Rights
Email [email protected] from the email address associated with your information, tell us which right you are exercising, and include the state where you live. We will verify your identity by confirming your control of that email address, and we will respond within the time required by your state's law (in Washington, generally 45 days, extendable once by 45 days where reasonably necessary).
7. Appeals
If we decline your request in whole or in part, you may appeal by replying to our decision with the word "Appeal" in the subject line. A different reviewer will consider your appeal and respond within the period your state's law requires (in Washington, 45 days). If your appeal is denied, you may contact the Washington Attorney General at www.atg.wa.gov/file-complaint (Washington residents) or your state attorney general.
8. Changes
We may update this policy from time to time. The Effective Date above reflects the latest version. We will not use consumer health data collected under this policy for materially new purposes without obtaining your consent.
